LIMITED WARRANTY

The manufacturer of BiWOOD Flooring products warrants that this product is free from defects in materials and workmanship in excess of 5% degrade allowance when the product leaves the manufacturer’s possession. The manufacturer warrants to the original consumer purchaser that the manufacturer will replace any product part which, under normal residential use, including adequate maintenance, proves to the manufacturer’s reasonable satisfaction to be defective within fifteen years of purchase. The warranty is void in the event of any of the following: Improper installation - Improper maintenance - Direct sunlight - Radiant Heated Slabs.

The manufacturer neither assumes nor authorizes any other person to assume for it any other obligation in connection with BiWOOD Flooring products. THIS IS THE COMPLETE AND EXCLUSIVE STATEMENT OF OUR WARRANTY, AND IS IN LIEU OF ALL OTHER EXPRESS, STATUTORY WARRANTIES OR IMPLIED WARRANTIES. ALL MANUFACTURERS WARRANTIES INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES, ARE LIMITED IN DURATION TO THE DURATION OF THIS EXPRESS WARRANTY. Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.

The manufacturers sole obligation under this warranty is limited to providing replacement or change of defective products. The manufacturer assumes no liability for defects, which are caused by improper shipping, handling and storage after product leaves the manufacturer’s possession. The manufacturer also makes no warranty with respect to defects, which are caused by improper preparation of the surface on which the product is installed, or by defective installation. In addition, this warranty does not extend to swelling, shrinkage or to insect infestation after the product leaves the manufacturer’s possession.

The manufacturer assumes no liability for incidental or consequential damages. However, some states do not allow the exclusion or limitation of incidental or consequential damages, so this exclusion may not apply to you.

The manufacturer warrants its products a full lifetime warranty against delamination not caused by negligence or water.

The purpose of this warranty is to allow for the replacement of defective products. This remedy shall be the buyer's exclusive remedy. This warranty shall not be deemed to have failed in essential purpose while the manufacture is willing to replace defective flooring.

THIS WARRANTY DOES NOT APPLY TO ANY PRODUCT DESIGNATED AS “OFF GOODS” INCLUDING, BUT NOT LIMITED TO SECONDS, ECONOMY GRADE, CABIN GRADE, THRIFT GRADE, SPECIALS OR NON-STANDARD ITEMS. ANY PRODUCT OR PRODUCTS SO DESIGNATED ARE SOLD "AS IS." THIS WARRANTY DOES NOT APPLY TO ANY PRODUCTS INSTALLED OVER RADIANT HEAT. The exclusive forum for enforcement of the provisions of this limited warranty shall be binding arbitration under the commercial arbitration rules of the American Arbitration Association in Memphis, Tennessee.

This Limited Warranty gives you specific rights, and you may also have other rights, which vary from state to state.
